In Florida, meanwhile, a federal judge could push back Trump’s trial date in the classified documents case. Special Counsel Jack Smith and attorneys for Trump proposed moving the trial later into the summer in court filings Thursday. CNN —In a surprise move, an Illinois judge has removed former President Donald Trump from the state’s ballot based on the 14th Amendment’s so-called “insurrectionist ban.”The decision is paused, giving Trump a short period of time to appeal. “The Illinois State Board of Election shall remove Donald J. Trump from the ballot for the General Primary Election on March 19, 2024, or cause any votes cast for him to be suppressed.”The judge stripped Trump from the Illinois ballot one month after the anti-Trump challenge was dismissed by the Illinois State Board of Elections. Illinois is now the third state where Trump was booted from the ballot, after Colorado and Maine. But those decisions were paused pending the appeal of the Colorado case to the US Supreme Court. CNN —The judge presiding over the Mar-a-Lago documents case on Tuesday denied efforts by Donald Trump’s co-defendants to view the classified records they allegedly moved around the former president’s Florida residence for him. The men, political aide Walt Nauta and property staffer Carlos De Oliveira, wanted to view the classified records to prepare their trial defenses against obstruction of justice charges. They are accused of helping Trump conceal documents he unlawfully kept in Florida after he left the presidency. Cannon has yet to rule on efforts by Trump’s attorneys for him to access a smaller collection of classified documents, which the Justice Department wants to protect because of their national security sensitivity. CNN —When it comes to deciding whether former President Donald Trump should be booted from Colorado’s ballot, the easiest path the Supreme Court could take now may wind up causing the most chaos early next year. In the ballot litigation, Trump is appealing a decision from the Colorado Supreme Court in December that he incited the attack on the US Capitol as electoral votes were being counted in 2021. Arguments at the US Supreme Court last week focused less on whether there was an insurrection and more on technical questions about whether states may enforce the ban. A political fight over eligibility would likely be limited to Congress, but it could sweep the Supreme Court back into the thicket, as well. “Depending on just how horrendously ugly the situation could get, the court might feel compelled to become involved,” Foley said.

One threat against a witness has prompted a federal investigation, the special counsel’s office wrote in court filings. Possible witnesses against Trump are “routinely” being threatened in a way that could intimidate them from participating in the case, they added. Trump has pledged to appeal and has until Monday to ask the Supreme Court to temporarily block the ruling. Perhaps to speed things along, the appeals court established a quick schedule for Trump to respond to Tuesday’s ruling, giving Trump until February 12 to file an emergency stay request with the Supreme Court. The Supreme Court, however, can take as long as it likes at each step. CNN —Most Americans want to see a verdict on the federal charges former President Donald Trump faces related to election subversion in 2020 before this year’s presidential election, according to a new CNN poll conducted by SSRS. About half of Americans, 48%, say it’s essential that a verdict is reached before the 2024 presidential election, and another 16% that they’d prefer to see one. Trump currently faces four separate criminal indictments, including federal charges related to his alleged efforts to overturn the results of the 2020 presidential election. Among those who see a pre-election verdict in the federal Trump election subversion case as essential, just 35% express trust in the Supreme Court on election-related cases. About half (48%) of Americans say they’d favor Trump attempting a mass deportation of undocumented immigrants and 39% that they’d favor repealing and replacing the ACA.

CNN —US Capitol Police have received a subpoena in the grand jury investigation into Rep. Cori Bush, sources familiar with the matter told CNN. FEC filings show that from January 19, 2023, through April 3, 2023, Bush’s campaign paid Merritts $15,000 for “security services” in six payments of $2,500. CNN asked Bush’s campaign if either she or Merritts were interviewed by the FBI, and if the campaign could provide timesheets for Merritts. “I also believe in transparency which is why I can confirm that the Department of Justice is reviewing my campaign’s spending on security services. Washington CNN —Special counsel Jack Smith’s office is defending how the federal government during Joe Biden’s presidency sought to repossess White House records Donald Trump took, and how the case evolved into a federal investigation. The prosecutors say Trump’s legal team has attempted to distort the events in his favor – including by claiming he had a security clearance that extended past his presidency. But the prosecutors on Friday wrote Trump’s team “not only knew” of the Biden White House being part of the discussion, they also approved of it. On Friday, the special counsel’s office argued the case’s evolution followed Justice Department protocol, including in how White House employees spoke with DOJ officials. Washington CNN —The Washington, DC, trial date in the federal election subversion case against former President Donald Trump has been postponed because of ongoing appeals about the power of the presidency, according to a new court order in the case. Though not official until US District Judge Tanya Chutkan’s order Friday, it became increasingly less likely that the March trial date would hold. The federal case against Trump had been set to begin first among the criminal indictments he faces. The Mar-a-Lago documents case judge, Aileen Cannon, a Trump appointee in south Florida, has left open the possibility of revisiting the trial schedule at a hearing March 1. The state-level judge presiding over Trump’s 2020 election conspiracy in Georgia has yet to set a trial date.

CNN —The federal appeals court in Washington, DC, declined to rehear arguments over whether former President Donald Trump can be prohibited from talking about witnesses and court staff while he awaits trial in the special counsel’s January 6 criminal case. However, filing for bankruptcy gave Giuliani an immediate pause from having to pay debts he owes. He is also looking to appeal the jury verdict in proceedings outside of bankruptcy court, which would require permission from the bankruptcy judge. After hearing testimony from Freeman, Moss and experts, a DC jury awarded the extraordinary sum for the harm he did to them. Washington CNN —Former President Donald Trump isn’t immune from being held accountable in civil lawsuits related to the January 6, 2021, US Capitol riot in a long-awaited, consequential decision from the federal appeals court in Washington, DC. The decision arises out of lawsuits brought by Capitol Police officers and Democrats in Congress. The district court did find that Trump was protected by presidential immunity from the claim that he failed to stop to the riot, saying that he would be acting in his official presidential powers in that instance. Trump still will be able to contest the facts of the case as the lawsuits move forward.
